Welcome to SpotKonnect. By accessing or using our mobile application, website, and services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

These Terms constitute a legally binding agreement between you and SpotKonnect. We reserve the right to update these Terms at any time, and your continued use of the Services constitutes acceptance of any changes.

2. Eligibility

To use SpotKonnect, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding contract
• Not be prohibited from using the Services under applicable laws
• Provide accurate and complete registration information
• Maintain the security of your account credentials

3. Account Registration and Security

Account Creation: You must create an account to use SpotKonnect. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your password confidential and secure
• Notify us immediately of any unauthorized account access
• Accept responsibility for all activities under your account

One Account Per Person: You may only create and maintain one account. Creating multiple accounts may result in termination of all your accounts.

4. The 200 Connection Limit

SpotKonnect enforces a strict limit of 200 professional connections per user. This is a core feature of our platform designed to promote quality over quantity.

• Once you reach 200 connections, you cannot add new connections until you remove existing ones
• This limit applies to all users without exception
• There is no premium tier or paid upgrade to exceed this limit
• Connection requests and acceptances count toward this limit

5. Acceptable Use Policy

You agree NOT to:

• Use the Services for any illegal or unauthorized purpose
• Violate any laws, regulations, or third-party rights
• Post content that is defamatory, obscene, abusive, or hateful
• Harass, bully, or threaten other users
• Impersonate any person or entity
• Collect or scrape data from the Services
• Use automated systems (bots, scrapers) without permission
• Interfere with or disrupt the Services
• Upload malware, viruses, or malicious code
• Share your account credentials with others
• Use the Services for spam or unsolicited marketing
• Create fake profiles or provide false information

6. Content and Intellectual Property

6.1 Your Content

You retain ownership of content you post on SpotKonnect ("User Content"). By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content solely for the purpose of operating and improving the Services.

6.2 Content Standards

All content must:

• Be professionally relevant and appropriate
• Not contain personal attacks or harassment
• Not violate any intellectual property rights
• Be accurate and not misleading
• Comply with all applicable laws and regulations

6.3 Our Content

• Suspend or terminate accounts that violate these Terms

We are not obligated to monitor content but reserve the right to do so. We will make reasonable efforts to notify you before taking action, except in cases of severe violations or legal requirements.

11. Termination

11.1 By You

You may close your account at any time through the app settings or by contacting our support team. See our Account Deletion page for instructions.

11.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Provide false or misleading information
• Engage in fraudulent or illegal activities
• Harm other users or the platform
• Remain inactive for an extended period (we'll notify you first)

11.3 Effect of Termination

Upon termination, your right to use the Services ceases immediately. We will delete your account and data in accordance with our Privacy Policy, except where retention is required by law.

12. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties regarding accuracy, reliability, or availability of the Services
• Warranties that the Services will be uninterrupted, secure, or error-free
• Warranties regarding user-generated content or third-party links

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPOTKONNECT SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Damages resulting from user content or conduct
• Unauthorized access to or alteration of your data
• Interruption or termination of Services

Our total liability shall not exceed the amount you paid us in the 12 months prior to the event giving rise to liability, or $100, whichever is greater.

You agree to indemnify, defend, and hold harmless SpotKonnect, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Services, your content, or your violation of these Terms.

15. Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms will be subject to the exclusive jurisdiction of the courts located in Wuppertal, Germany, or the competent courts in Germany.

15.2 Informal Resolution

Before filing a claim, you agree to contact us at spotkonnectteam@gmail.com to attempt to resolve the dispute informally.

16. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting a notice on the Services or sending you an email. Your continued use of the Services after changes become effective constitutes acceptance of the new Terms.

17. Miscellaneous

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SpotKonnect.

17.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full effect.

17.3 No Waiver

Our failure to enforce any right or provision in these Terms shall not constitute a waiver of such right or provision.

17.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
